Foster Teen Accuses Det. Oldy Ochoa of Sexual Abuse

A foster teen's allegations included in a search warrant the Pembroke Pines clerk’s office released Monday read like a script for porn.

The characters: A veteran Miami Beach detective and a teenage girl with a criminal record trying to graduate from high school.  The dark twist: She was in foster care and was living in Miami Beach Det. Oldy Ochoa's home with his wife -- a retired Miami Beach police officer. They have three sons and two step-sons.

Pembroke Pines Police Capt. Al Xiques said the investigation is ongoing.

"We are waiting on the results of DNA tests," Xiques said. "Those usually take a few weeks."

It was a day before Valentine’s Day. The two were in an unmarked 2013 silver Ford Fusion Miami Beach police car with dark tinted windows. Ochoa was taking the teen to Florida Career College, 7891 Pines Blvd., in Pembroke Pines, when he allegedly decided to park "in a secluded alley."

They kissed "in a passionate manner," the girl said. Oral sex followed.  The girl "straddled on top" of the officer who was in the driver's seat.  He didn't wear a condom and used a towel to clean himself.

The girl said she and the detective, a 24-year-veteran with Miami Beach police, "were often flirtatious with each other" via e-mail and Facebook. He also used his mobile phone to take pictures of her "while she posed," a search warrant said.

There was a second time when he used a condom, but he dropped it on the floor, the girl told police March 4. Six days later, Pembroke Pines police detectives took DNA swabs and a towel from the Miami Beach police car.

"We are cooperating with the Pembroke Pines Police Department to make sure there is a thorough investigation," Miami Beach Chief Raymond Martinez said in a statement earlier this month.

The Department of Children and Families spokeswoman Paige Patterson-Hughes said in an e-mail earlier this month the abuse report and the girl's status were confidential.

The Ochoa family declined to comment. And Miami Beach police said the detective remains suspended with pay pending the results of the investigation.

Two Former Officers Indicted on Sex Abuse Charges

A grand jury has indicted a former Kentucky State Police trooper and a former Brandenburg police officer on sex abuse charges.

The two are accused of sexually abusing a 15-year-old.

Former KSP Trooper Stratford Young was indicted on one count of rape third-degree and two counts of third-degree sodomy.

"It's disappointing for several families, for our agency, for the state of Kentucky," said Trooper Jeff Gregory.

Former Brandenburg police Officer Todd Matti was indicted on two counts of third-degree sodomy.

Special prosecutor Tom Wine told Judge Bruce Butler they chose not to present indictments against other individuals, but did not say why.

Both men entered not guilty pleas at their arraignments Monday afternoon.

"We protect and we serve, to the best of our ability, and at times things happen that may not represent our agency the way we want it represented," said Gregory.

Former Officer Patrick Earwood Charged with Molesting Girls Due in Court



A former Cave Spring police officer accused of molesting girls and forcing women into sexual acts is scheduled for an arraignment next month.

Patrick Edward Earwood, 31, remained in jail Friday without bond. Earwood is scheduled to appear April 11 before a Floyd County Superior Court judge.

Earwood has the option of having his charges read to him at the arraignment.

Prosecutors allege Ear wood coerced girls and women to perform sex acts or expose themselves.

Authorities first learned of the allegations when a girl alleged she rode in Earwood’s patrol car, and that he asked her for sex, police reported.

An investigation began, which led detectives to two different women.

According to an order by Superior Court Judge Tami Colston:

The first woman said Earwood arrested her and took her to City Hall. Earwood then told her he’d free her if she gave him oral sex. When she said nothing, Earwood returned her to his patrol car and began driving to the Floyd County Jail.

“On the way to the jail, Defendant Earwood said ‘are you going to do this or not?’” the order states. “She responded, ‘You know, I’m going to have to do this?’ He said yes and pulled off the road.”

The woman performed oral sex on Earwood, and he then took the woman to meet her mother. She did not go to jail.

The second woman said she encountered Earwood when he arrested her for DUI. Earwood said they could “work something out” if her boyfriend wasn’t in the car. She thought little of the comment, and Earwood took her to the police station for a breath test. When she failed the test, Earwood put her in his patrol car and began driving to jail.

“On the way to the jail, Earwood offered to lower one of the traffic charges if she would let him touch her breasts,” the order states. “She moved up closer to him and he fondled her breasts on the way to the jail.”

Earwood faces two counts each of aggravated sodomy, second-degree child cruelty, sexual battery and sexual assault against a person in custody. He also faces charges of aggravated child molestation, child molestation, giving false statements and violation of his oath by a public officer.

Fort Hood Sgt. Gregory McQueen Faces Several Charges

 A Fort Hood sergeant who was a coordinator of the post's sexual assault and harassment prevention program faces multiple charges after he was accused of setting up a prostitution ring involving cash-strapped female soldiers.

Sgt. 1st Class Gregory McQueen was charged Friday with 21 counts related to pandering, conspiracy, maltreatment of a subordinate, abusive sexual contact, and adultery and conduct of a nature to bring discredit to the armed forces, according to a Fort Hood statement.

An Article 32 hearing, the military equivalent of a civilian grand jury proceeding, is scheduled for March 20 and 21 at Fort Hood.

It was not clear if McQueen had an attorney Friday, Fort Hood spokesman Christopher Haug said. A home number for McQueen could not be found.

Last May, the Army said a sergeant first class was being investigated on allegations of sexual assault and possibly arranging for at least one woman to have sex for money. The Army said he was one of the coordinators of the program at Fort Hood, about 125 miles southwest of Fort Worth.

Army officials declined to release his name at the time, but two officials speaking anonymously to The Associated Press because they were not authorized to speak publicly about the case identified that soldier as McQueen, who was assigned as a coordinator of a battalion-level sexual assault prevention program at the Central Texas Army post.

U.S. officials had said he was being investigated in connection with activities involving three women, including sexually assaulting one woman. At the time, a Defense Department official in Washington said it was not clear if one of the women was forced into prostitution or participated willingly. McQueen remains suspended from his duties but is free pending trial, Haug said.

Another Fort Hood soldier was court-martialed in the case. Master Sgt. Brad Grimes was convicted in December of conspiring to patronize a prostitute and solicitation to commit adultery, reprimanded and demoted.

The Fort Hood case and others like it have increased pressure on the Pentagon and Capitol Hill to confront sexual misconduct in the armed forces.

The charges against McQueen came one day after the Senate rejected a bill that would have stripped military commanders of the authority to decide whether to prosecute serious crimes.

The legislation was sponsored by Sen. Kirsten Gillibrand, D-N.Y. and chairwoman of the Senate Armed Services personnel subcommittee. In a Feb. 10 letter, she called on Defense Secretary Chuck Hagel to turn over case information from four major U.S. bases, including Fort Hood.

The records would shed more light on how military commanders make decisions about courts-martial and punishments in sexual assault cases.

Officer Robb Gray Evans Arrested for Sexual Abuse

The Flagstaff Police Department (FPD)arrested Arizona DPS Officer Robb Gray Evans of Flagstaff late Saturday night. Officers responded to the Greenroom Bar in Flagstaff to a report of a male subject who had inappropriately touched a 30 year old female.

According to officers, they were contacted by the employees of the Greenroom Bar who were out with the alleged suspect. Speaking to the female victim, she told officers she was standing at the bar when the suspect had come up behind her and began inappropriately touching her. The woman said she confronted the male suspect and reported the incident to bar employees.

The suspect identified himself to police as an Arizona DPA Officer which was later confirmed by FPD officers.

Evans has been booked into the Coconino County Jail for one count of Sexual Abuse and is being held on $50,000 bond. According to the FPD, the investigation is still on going.

Corrections Officer Mark Barber Accused of Extorting Sexual Favors From Inmates

A Long Island corrections officer is being accused of extorting sexual favors from female inmates.

Nassau County District Attorney Kathleen Rice says 47-year-old Mark Barber, of Levittown, was arrested Wednesday and charged with multiple counts of rape, sexual abuse, and forcible touching.

Rice says Barber used his position as a grievance officer for the Nassau County Correctional Center to engage in various sexual activity with female inmates.

Rice says Barber, a corrections officer since 1987, would target inmates who had histories of drug abuse, prostitution, or mental health treatment.

Barber's lawyer, Frederick James Annibale Jr., told reporters that his client denies the charges.

Barber is due back in court Jan. 4. If convicted, he faces up to 16 years in prison.

More Woman Come Forward Against Deputy Donald Harder III Accused of Forced Sexual Contact

More women have come forward to accuse a Saratoga County sheriff's deputy of forced sexual contact while he was on the job and in uniform.

Donald A. Harder III, 29, of Hadley was indicted Thursday in Saratoga County Court on 11 additional charges of criminal sexual act, sexual abuse, forcible touching and official misconduct, District Attorney James A. Murphy III said.

Murphy said three women came forward with complaints against Harder after hearing of his Aug. 13 arrest, when a 27-year-old acquaintance told police the police officer forced her to commit a sexual act on him. Harder had responded to a call to assist with a civil matter on Shields Road in Edinburg and the alleged sexual incident occurred on a roadside.

Harder, who has worked for the department for three years, allegedly forced sexual contact with all four women while he was on duty.

In the new allegations, one woman reported that Harder forcefully touched her in a sexual way on June 2 and 3 at the sheriff's substation in Corinth while the deputy was investigating a crime.

A second woman has alleged unwanted sexual contact from Harder in the summer of 2007 and in June and July of this year. The June incident allegedly occurred in a store in Greenfield, officials said. That woman first had contact with Harder as a crime victim and then later as a suspect in a case Harder investigated.

The third woman accused Harder of sexual contact that allegedly happened several years ago, for which the statute of limitations had run out, Murphy said. Harder faces a charge of official misconduct for that incident.

"These allegations were as shocking to me as they were to the sheriff," Murphy said in a news release announcing the indictment. "He and I were both very concerned about this alleged conduct and that is why, after a full investigation, the grand jury heard the case. These women were terrified and frightened."

The grand jury had been hearing the case over the last several weeks from the alleged victims and from other law enforcement personnel.

''This guy went over the line,'' said Sheriff James Bowen, who plans to attend Harder's arraignment Tuesday in Saratoga County Court. ''This guy let everybody down. We investigated it thoroughly. We turned it over to the D.A.''

Murphy said the deputy has been suspended without pay until the conclusion of his criminal case. He is married with three children.

Byron Shane Burkhart Indicted for Indecency with Child

A 41-year-old former Seguin Police Department officer has been indicted on charges of indecency with a child.

District Attorney Heather Hollub said grand jurors handed up a three-count indictment of Byron Shane Burkhart for the alleged indecency with a child under age 17 by sexual contact.

If proved at trial, the allegation is a second-degree felony punishable by two to 20 years in state prison and a fine of up to $10,000. Since Burkhart has no prior criminal offenses, he could also get probation.

“It’s always troubling when those we entrust with protecting us commit criminal offenses,” Hollub said. “My office will prosecute this case to the fullest extent of the law.”

The Seguin Police Department brought the allegations against Burkhart forward after being informed by school officials and members of an outside law enforcement agency of an alleged inappropriate relationship between Burkhart and the girl believed to have taken place back in February.

Police officials asked for independent investigations by the Texas Rangers and by Hollub’s investigator, Frank Allenger. Burkhart is one of two Seguin police officers who came under a cloud of sexual suspicion last spring in separate, unrelated incidents. He resigned his position in late May.

The second officer, who quit his job in June after being placed on administrative leave pending the outcome of an investigation into an allegation involving an adult woman, has not been charged with a criminal offense.

Kelso informed Burkhart of the allegations in a May 29 letter telling the officer he was contemplating firing him. That letter was released by the city of Seguin in response to a request filed by the Seguin Gazette Enterprise under the Texas Public Information Act.

“I am considering termination of your employment for conduct unbecoming an officer of the Seguin Police Department,” Kelso wrote. “Specifically, it is alleged by two local educators that you have engaged in an improper relationship with a minor child and that you are responsible for inappropriate communications (text messages) with that child.”

Kelso informed Burkhart of his expected behavior as a city employee.

“You are a public servant and as such, you are held to the highest standard of ethical conduct,” Kelso said. “Consistent with that level of public trust, the behavior alleged certainly would not be considered to be in the best interest of the City of Seguin and therefore would subject you to discipline up to and including termination.”

The indicted charges suggest there was more involved in the relationship than texts or e-mails.

Under section 21.11 of the Texas Penal Code, Indecency with a child by sexual contact is defined as, “ ... any touching by a person, including touching through clothing, of the anus, breast or any part of the genitals of a child ... .”

Kelso and city officials declined to discuss the allegations against Burkhart on Monday.

The important thing, Kelso said, is that the community not regard allegations against one officer as a reflection on the behavior of the rest of the 65 members of the SPD. As soon as the allegations were made, they were investigated at the behest of the police department, with its cooperation, Kelso said.

“We’ve been proactive in this situation. Any time an allegation is made against any police officer it will be investigated and action will be taken that is appropriate to the outcome of that investigation. The department should be judged by the way the allegation or incident is handled as opposed to the improprieties of an employee. It is difficult to monitor every moment of each officer both on and off duty, but we expect them to abide by the rules governing their employment.”

Burkhart was an eight-year veteran of the SPD. No pre-trial hearing dates had been set Monday.

The Seguin Police Department has cooperated openly and completely in the investigations, Hollub said.

Former Officer Arthur 'Perry' Gooch Arrested for Sexual Abuse

A former Athens Police officer was taken into custody Thursday by Limestone County Sheriff’s investigators on a warrant from Madison County charging him with sexual abuse, a local official said.

Limestone County Sheriff Mike Blakely said his office received a warrant to pick up Arthur “Perry” Gooch, 37, of Autumn Lane. County authorities transported Gooch to the Madison County line and released him to the custody of the Madison County Sheriff’s Department.

The warrant stemmed from a Madison County grand jury indictment, Blakely said.

Gooch was initially arrested in Huntsville on a charge related to a November 2007 incident when a woman, the wife of an acquaintance, accused Gooch of kissing her and running his hand up her skirt while they were near the dance floor of the club on the night of Nov. 3, 2007.

The case was dismissed by the Madison County District Attorney in February 2008.

In 2008, Gooch denied the accusation but resigned from the force Nov. 9, 2007, after serving as a patrol officer for about five years.

A call to the Madison County District Attorney’s office to determine why the case was reopened was not returned Friday.

Gooch was taken to Madison County Jail and was released on bond.

Veteran Officer Arrested for Sexual Assault

A 22-year veteran of the Springfield Police Department has been arrested on charges of criminal sexual assault and sexual relations with family.

The Associated Press isn't naming the 51-year-old officer because he hasn't been formally charged.

He's in custody at the Sangamon County Jail on $250,000 bond.

Springfield police say the officer was arrested Sunday evening on charges of predatory criminal sexual assault, criminal sexual assault, aggravated criminal sexual abuse and sexual relations with family.

No other details have been released about the alleged victim or the victim's relationship to the officer.

Springfield police say the officer has been placed on administrative leave pending the outcome of criminal and internal affairs investigations.

Former Deputy Mark Petrina Accused of Sexually Abusing several Young Girls

Five victims have accused Mark Petrina, a former Kern County Sheriff's deputy, of sexually abusing them at his house in Bakersfield. The police have also identified three other victims who say they were also sexually abused, but they wouldn't go on the record.

According to court documents, the eight victims said they were molested over a period of several months, and sometimes years, while they were young, and just beginning puberty. Two of those victims are now adult women, who say Petrina sexually abused them when they were young, more than 30 years ago.

The investigating detective called several of the alleged victims, and each girl told roughly the same story, that Petrina would molest them in his bed, by touching and fondling their private parts. One girl reported she remembered Petrina giving her toys after the molestations were over.

Petrina was recently extradited to Kern County from Aberdeen, Wash. The Bakersfield Police Department said Petrina moved there earlier this year after he became aware of the molestation investigation.

Petrina is now retired, but as a sheriff's deputy court documents show, Petrina was primarily assigned to jail operations. He has been placed on suicide watch while being held in jail.

Petrina has pleaded not guilty to five felony charges of lewd or lascivious acts with a child under 14 and one felony count of continuous sexual abuse of a child. Those charges stem from the alleged abuse of only three of the listed victims. Petrina is due back in court for his pre-preliminary hearing on June 18. His bail is set at $270,000.

Correction Officer Ronald Martin Charged with Sexually Abusing Inmate

A correction officer at Franklin County Jail was charged Thursday with sexually abusing a female inmate.

Ronald S. Martin, 36, of St. Regis Falls was charged with second-degree sexual abuse and official misconduct.

State Police say the abuse occurred April 10, while Martin was working as a correction officer at the County Jail and the woman was incarcerated there.

Sheriff Jack Pelkey said he suspended Martin without pay April 30 and asked the State Police to conduct an investigation, which ended in the arrest Thursday.

The sheriff was careful with his comments so as not to jeopardize the investigation but said two other women being held at the jail had complained about Martin's actions toward the 24-year-old female.

"Two female inmates approached a guard and said something's going on with a guard and another female," Pelkey said.

"They thought his behavior was inappropriate for a correction officer and didn't think it was right what he was doing to the other female."

Pelkey said he could not elaborate on what Martin is accused of doing, saying only that it was alleged "sexual contact" with the woman.

If a woman is in jail, she cannot legally give consent to any sexual act, the sheriff noted.

Martin has been employed by the county since March 31, 2000, first as a per-diem correction officer and then as full-time employee as of Aug. 3, 2001, according to the Franklin County Personnel Office.

He was released without bail and is to appear in Malone Town Court at 9 a.m. next Thursday.

Officer Wilfredo Rosario Charged with 4th Rape

NEW YORK

A New York City police officer who was previously charged with sexually abusing three women has been charged with raping a fourth victim.

Wilfredo Rosario was arrested Thursday and arraigned in state Supreme Court in Manhattan on charges including felony rape and sexual abuse.

He pleaded not guilty, and his lawyer, Glenn Morak, says he will fight the charges vigorously.

Rosario is suspended from duty at the 26th Precinct in Harlem.

Prosecutors say Rosario raped a woman in her apartment in 2003 and then stalked her in 2008.

He was previously indicted twice on sexual abuse charges involving three different women.

Prosecutors say all of the women had asked about after-school programs for their children.

Rosario is being held on $150,000 bail.
