Former Officer Cody Smith Arrested for Rape of Child

A 39-year-old man who worked temporarily for both the Logan City Police and the Cache County Sheriff is expected to appear in court Thursday on multiple felony charges.

Cody Smith was booked into the Cache County Jail Tuesday afternoon. He’s being held on two counts of rape of a child, three counts of rape, one count of object rape, one count of forcible sexual abuse and three counts of aggravated assault.

Utah State University Police Chief Steve Mecham said his department was asked to investigate the case because Smith has a brief employment history with both the Logan City Police and the Cache County Sheriff.

According to Logan City Police Assistant Chief Jeff Curtis, Smith was a reserve officer, volunteering with the department, after graduating from the police academy in the mid-90's.

Curtis said Smith was never hired permanently and left the department to try and get a job with the Cache County Sheriff's Office.

Sheriff Lynn Nelsen said Smith volunteered for the sheriff's office from May 1999 to October 1999. He was then hired full-time and began the “Field Training Program,” a 12-week program to qualify for full-time service.

Nelson said Smith was terminated during the program for not meeting department standards in December 1999.

Bail has been set at $100,000.

Officer Brent Schade Arrested for Forcible Rape of Minor

    Chillicothe Police Officer Brent Allen Schade who had been on unpaid administrative leave since Jan. 24 was arrested today (Wednesday) for alleged forcible rape, forcible sodomy and two counts of supplying intoxicants to a minor.

    On Tuesday, the Livingston County Sheriff’s office began an investigation into an alleged rape, sodomy, unlawful restraint and supplying intoxicants to a minor. The incident was reported to have taken place over the night of March 3 and into the early morning or March 4 in the 300 block of Cherry Street in Chillicothe.

    Schade, 40, of Chillicothe, was arrested early today.

    A variety of evidence has been collected and/or is currently being sought, according to Livingston County Sheriff Steve Cox.

    “A second person of interest was identified and we are seeking that individual at this time for questioning,” Cox said. “Several people have been interviewed and the investigation continues.”

    Schade has been on the police force since August 2007 and is currently on unpaid administrative leave, stemming from an incident last year.

    Schade was charged Jan. 24 with hindering prosecution and tampering with physical evidence by Brady Kopek, special prosecuting attorney of Livingston County.

    According to the probable cause statement, Missouri State Highway Patrol Cpl. J. Pithan investigated a traffic accident on Aug. 18 on Route V near Chillicothe involving two individuals. During the course of the investigation, Pithan reportedly discovered both occupants of the crashed vehicle walked to a nearby residence and called Schade. The investigation suggests Schade drove to their location and provided transportation to both subjects before returning to the scene of the accident. Schade allegedly assisted with the recovery of personal items belonging to both subjects, including cell phones and a bottle of Captain Morgan. Schade allegedly did not report the accident to authorities and transported the two individuals to his residence in Chillicothe.

    Schade remains incarcerated in the Daviess Dekalb County Regional Jail pending filing of formal charges. Kopek is also the special prosecuting attorney on this most recent case.

Investigation Ongoing for Officer Accused of Forcible Rape of Teen

It's been nearly a month since a high school student accused a Memphis Police Officer of forcibly raping her. No charges have been filed in the case. What's taking so long?

The 17-year old goes to Fairley High School in Whitehaven. She reported the rape to a police officer at the school on February 5th. She said happened off-campus on an earlier day.

Students at Fairley high school say they haven't heard much about the rape accusations since they were first reported a month ago.

“They really aren't saying a lot about it,” said Senior Jeremy Ross. “I think they're just trying to let it go.”

The Memphis Police Department put the officer on “Non-Enforcement” status pending the investigation. An investigation it says is still ongoing. Some of you want to know what's taking so long.

The MPD told Eyewitness News it was waiting on forensic testing. That's done by the Tennessee Bureau of Investigation. The TBI says DNA results take an average of nine weeks to complete in the Memphis lab.

“If you look around at other states,” said TBI spokeswoman Kristin Helm. “That’s probably one of the fastest DNA turnaround times that you'll find at any crime lab at any state.”

It can be done faster, however.

“Something that's a very serious nature that needs to be expedited, that's a threat to public safety,” said Helm. “They can always request us to expedite things and of course we will do that for them.”

Eyewitness News asked the Memphis Police Department about this case and if there was any consideration given the fact the accused is a Memphis Police Officer. The department issued a statement saying "This is a complex investigation and will take time. Sex crimes asked for an expedited examination when they submitted the request." The statement went on to say, ”This case is being investigated as any other complaint.”

The Sex Crimes Bureau and the Inspectional Services Bureau, the department that investigates criminal wrongdoing by officers, are working on the case.

Former Officer Gregory Perkins Charged with Sex Crimes Against Minors

A former Durham police officer is charged with sex crimes against a minor.

The Apex Police Department arrested 40-year-old Gregory A. Perkins for seven felony counts of sex related crimes Friday.

Perkins has been charged with two counts of first degree forcible sexual offense, two counts of statutory sex offense against a 13, 14 or 15-year-old, first degree statutory rape, statutory rape of a 13, 14 or 15-year-old, and other charges.

Further details about the incidents have not been released.

According to police, Perkins is being held on a $1 million bond.

Officer Stephen Olenchak Accused of Raping Teen


A Davie police officer was arrested Thursday, accused of raping a teenage girl while his wife lay unconscious next to them, according to police.

Stephen Olenchak, a 34-year-old police officer, was charged with two counts of sexual battery without consent on a girl over 12 years old. Police said the teenage girl was at Olenchak's home on March 22 when he, his wife and the girl watched the HBO television show Big Love.

The girl told police that Olenchak served the girl and his wife drinks that made them drowsy. While his wife slept nearby, Olenchak grabbed the girl from behind and raped her, according to the police report.

The girl told police she was not coherent enough to call out to Olenchak's wife for help.

Olenchak was arrested Thursday evening and taken to a Broward jail. He was released on $10,000 bond at 3:34 a.m. Friday, according to prison personnel.

Davie police spokesman William Coyne said that Olenchak will be placed on administrative leave pending an investigation into his actions.

The girl's family placed a restraining order on Olenchak, and a Davie police officer was assigned to keep watch over the family, Coyne said.

Former Officer Pedro Martinez Back in Court on Rape Charges

A 20-year city police officer was ordered held on $250,000 cash or surety after he pleaded innocent Monday to 25 counts of sexual crimes involving three victims, including two of his biological daughters.

Assistant District Attorney John Compton had asked for bail of $250,000 cash, with no surety option, saying Pedro J. Martinez faces such long sentences if convicted that he has an incentive to flee.

Raipher D. Pellegrino, Martinez's lawyer, asked that he remain free on the $25,000 bail set in District Court when Martinez was arraigned on three counts of forcible rape of a child and three counts of incest.

"He maintains his innocence," Pellegrino said.

Hampden Superior Court Judge Bertha D. Josephson said that the court must make bail decisions on the likelihood of a defendant to appear in court if released on bail, and added the surety option to Compton's request.

If Martinez is released he will be on electronic monitoring with a zero curfew as he has been since release on bail on the District Court charges, and he must have no contact with the victims.

A pre-trial hearing will be held July 21.

Outside the courtroom after the arraignment, Springfield police Special Victims Unit Lt. Cheryl C. Clapprood said the investigation was very difficult in part because "we have known him for so long."

She said that the man before the court Monday is not the man fellow officers thought they knew.
Clapprood said she was not sure whether there would be any more victims coming forward, but she expects there will be more evidence. The third victim is a female who lived in Martinez' house for a time, she said.

She said the investigation encompasses events as far back as 1985.
