Law-enforcement officers are supposed to be protectors of the public. As such, they make claim to certain rights and privileges in the use of force and other techniques denied the rest of us. They demand deference from the masses for the supposed extra risks they take in keeping the peace. And then ... every now and then one of them reminds us that it's not always wise to hand carte blanche to normal humans with feet of clay -- or worse, the souls of sexual predators. Predators like former Sheriff William E. Keating of Montague County, Texas.
On January 29, 2009, 62-year-old Bill Keating pleaded guilty in federal court to extorting sex from a woman as the price for avoiding drug charges. According to the U.S. Attorney's Office for the Northern District of Texas:
[A]t approximately 9:00 a.m. on Friday, November 14, 2008, Sheriff Keating, dressed in civilian clothes with his sheriff’s badge and gun in plain view on his belt, and other Montague County Sheriff’s Office employees, executed an arrest warrant at a residence occupied by the victim, L.M., and her boyfriend. As they entered the residence, L.M. and her boyfriend were asleep in a bedroom of the house. Sheriff deputies arrested the boyfriend on the outstanding warrant and removed him from the bedroom. Deputies searched the residence and discovered a bag that contained utensils and other articles used to manufacture methamphetamine. Deputies also located a plastic container that appeared to have trace amounts of methamphetamine on it.
After deputies removed the arrested man from the bedroom, Sheriff Keating ordered the other deputy to leave the bedroom so that L.M. could get dressed. Sheriff Keating then closed the door and, once alone with L.M., told her, “You are about to be my new best friend.” He told her that he found illegal drugs in the residence that belonged to her and that for her to avoid going to jail, she would be required to “assist” him. Keating admitted that the assistance he referred to included oral sex with him on multiple occasions and an agreement to act as an informant for the Montague County Sheriff’s Office. Keating told L.M. that if she complied with his request, that he would help her get a job, a place to live and that she wouldn’t be criminally charged with possessing any drugs or drug-making equipment that was found in the home. Keating also told her that if she didn’t comply, she would go straight to jail.
In court, Keating disputed none of the elements of the charges against him.
Of course, it's still good to be a cop. Keating was allowed to roam the streets until Judge Robert K. Roach decides what to do with him. According to news reports, Assistant U.S. Attorney Rick Calvert "said he did not oppose Keating's remaining free until the sentencing because this crime and other alleged misdeeds happened when he was acting as the sheriff..."
Rape, apparently, isn't quite so bad when you're wearing a badge.
State authorities plan to take their own crack at Keating. Maybe they'll dig a little deeper and ask him just what he did, and who he did it to, with that "rack made of nails" discovered in the jail he administered until the end of last year.

Former Officer Michael Johnson Accused of Raping Woman Takes His Own Life
A Pennsylvania municipal official accused of raping a woman in Baltimore was found dead yesterday after an apparent suicide in upstate New York, authorities said.
Michael L. Johnson Jr., 40, of York, Pa., shot himself in the head and chest after fleeing U.S. marshals and hiding in the closet of an apartment in Cohoes, N.Y., law enforcement officials said.
Federal authorities and local police were closing in on Johnson when they heard gunshots come from a room the fugitive had locked himself into, according to Gary Mattison, supervisor of the Albany, N.Y., division of the U.S. Marshals Service.
About an hour later, officers knocked down the door and found Johnson, Mattison said. He is believed to have died at the scene, authorities said.
Johnson, president of the Penn Township Board of Commissioners, disappeared about two weeks ago after he was released on $100,000 bail after being charged with raping a Baltimore woman. Police eventually linked Johnson to two other rapes in York, where he had served as a police officer. In each incident, he is accused of posing as a police officer and raping a woman in a minivan.
According to court documents, Johnson, a York police officer from 1994 to 1999, was born in Baltimore and was an Army veteran. He was also a married father of two who ran for Congress in 2002.
Police said Johnson picked up a 21-year-old woman in the Baltimore Highlands area Nov. 2 and told her he was arresting her for prostitution as part of a sting operation. According to court records, he handcuffed her to the back seat of a minivan, drove her to an industrial area in the rear of the 4400 block of E. Monument St. and sexually assaulted her.
The victim gave investigators a license plate number and a description of the silver van, information that led to Johnson's arrest after a two-hour standoff. Although he was released on bail, Johnson was to turn himself in after allegations of the two other rapes. But he failed to do so and had been on the run since.
Mattison said police didn't know why Johnson was in New York.

Former Sgt. Mike Rodrigues Arrested on Fourth Rape Charge

Deputies arrested former Sheriff's Sgt. Mike Rodrigues today on suspicion of a fourth rape charge, and a judge later released him on his own recognizance, according to authorities.
Rodrigues was set to be arraigned today on suspicion of three previous rape counts alleged by a grand jury. While walking toward the San Benito County Courthouse, authorities "peacefully" took him into custody, said Sheriff Curtis Hill.
The sheriff, for the second time since Rodrigues' first arrest on rape charges in December, apologized to the community and also said he's "not happy" with the visiting judge's decision to release Rodrigues after authorities charged him with the additional rape count, along with two other felony counts alleging possession of firearms and ammunition while under a restraining order.
Authorities today also charged Rodrigues on three misdemeanor counts on suspicion of violating a restraining order.
The visiting judge, from Napa County, arraigned him on the prior rape counts and released Rodrigues on the condition that he agree to turn in his passport and not leave the county, Hill said. After Rodrigues' December arrest, the suspect posted the $300,000 bail and was released from the San Benito County Jail.
"While he was on bail he continued to violate the law, including possessing a gun and ammunition," Hill told the Free Lance. "These allegations are from citizens that live and work in this community. When people hear this they'll think, 'If I did that, I would be in jail.' That's what Joe Six-Pack is going to think. I am very disappointed in the judge's decision."
Although Hill said Rodrigues was peacefully arrested, defense attorney Arthur Cantu contended otherwise and argued the case is "nothing more than a witch hunt."
If you have seven or eight deputies grabbing you and forcefully putting handcuffs on you and putting you under arrest, that by definition is an incident," Cantu said. "How dare they file new charges? How dare they file new charges? This is nothing more than a witch hunt. This is nothing more than a vendetta between Mikey and his enemies in the sheriff's department."
An investigation of Rodrigues, a 25-year sheriff's office veteran, resulted in the December indictment alleging three counts of forcible rape, two counts of unlawful sexual penetration and one count each of spousal rape, domestic violence and attempted rape.
The sheriff today said he's sorry for the Rodrigues ordeal - he apologized emphatically in December after the indictment as well.
"I want to apologize to every man woman and child in San Benito County," Hill said today. "We work to build trust in the community, and these allegations break that trust down."

Former Employee of Sheriff's Office Pleads Guilty to Rape of Child

A former Shelby County Sheriff’s Office employee pleaded guilty to charges of Rape and Rape of a Child.
According to court documents, 60 year-old Wayne Logan has been sentenced to six years in prison for rape and eight years for raping a child after pleading guilty, Thursday, September 11, 2008.
The Shelby County District Attorney’s Office says Crawford had sex with an 8 year-old girl several times over a two year period. Investigators say the girl’s mother knew about the rape and took money from Crawford. She was indicted on charges of Facilitation of Rape and Facilitation of Rape of a Child.
Police say the abuse was brought to the attention of authorities after the little girl told her teacher that Crawford was having sex with her.
Crawford worked as a civilian employee at the Shelby County Sheriff’s Office.

Officer Garry Ferguson Pleads No Contest
A Maricopa Police officer accused of having sex with minors entered a plea of no contest in court Monday afternoon.
Last week, 30-year-old Garry Ferguson rejected a plea deal, that would have put him behind bars for nine years.
Monday the prosecutor said she will ask for only eight years.
Ferguson is accused of sexually abusing three teenagers in Kings County. He is also being investigated in Kern County for sexual misconduct with a minor.

Altoona Police Officer Herrick Johnson is on paid administrative leave. State police say the 49-year-old Johnson met the girl through a site that promoted law enforcement careers. State police say Johnson drove to Indiana to pick up the girl at her family's home in July.
The city's pension board must rule on Johnson's request to retire effective Aug. 20, the day of his preliminary hearing on the charges. Johnson's pension would be based on 50 percent of his base pay.
City officials say the officer likely won't forfeit his pension due to the sex charges.

Officer John Sickels Charged with Rape WILL NOT get his Job Back

A former Creston police officer accused of sexually abusing a woman is still off the force after losing an appeal to get his job back. Former assistant police chief John Sickels is charged with raping a woman at the Crestmoor Golf Club in April and was fired shortly thereafter.
On Monday, Creston's civil service commission upheld that firing, saying that Sickels admitted to lying to investigators. Those lies are grounds for termination.
Former Creston police chief James Christensen is accused of looking on as the rape happened. Christensen was also removed from his job. Both are scheduled to go on trial November 17.

A former state trooper accused of rape will not have a trial or go to jail in Clinton County.
Court officials said Richard Keener pleaded guilty to misdemeanor charges just a day before he was trial was supposed to start.
Instead of sexual assault, Keener pleaded guilty to unlawful restraint and indecent assault.
A judge sentenced the former trooper to ten years probation and a $1,000 fine.
Police said keener raped a woman he met in a bar in Lock Haven.
Keener served as a state trooper in central Pennsylvania for 12 years.

Husband Charged With Kidnapping and Assaulting Wife
A Fort Bliss, Texas, soldier reported missing and possibly in danger was located by authorities Sunday after she was kidnapped and assaulted by her husband, El Paso, Texas, police said Monday.
The 34-year-old husband was arrested on charges of aggravated kidnapping and is now being held on $75,000 bond, said El Paso Police officer Chris Mears.
The complaint affidavit against him says he kicked, stabbed and raped his wife, according to the El Paso Times.
CNN does not identify alleged victims of sexual assault without their consent and is not naming the husband because it could lead to the soldier's identity.
Hospital officials at Fort Bliss told The Associated Press the woman had been treated and released.
The 29-year-old private first class had been reported missing Friday when she failed to show up for work at the base.
Mears said the man had been distraught after his wife told him she would be ending their relationship, and he waited in her off-post apartment until she came home late Thursday night.
When she arrived, Mears said, he stabbed her twice and forced her to drive with him to Las Vegas, Nevada. The two returned to El Paso on a Greyhound bus, he said.
There was no indication why he chose Las Vegas as their destination, Mears said. El Paso police are working with their counterparts in Las Vegas, he added.
The man went to police after seeing a newspaper article about the disappearance, said Mears, who refused to comment on whether he had confessed to any crime.

Lower Bond Denied for Officer Accused of Rape

WAUKEGAN
A Lake County judge denied a motion to lower the bond of the former Waukegan police officer accused of raping a woman while on duty.
Judge Raymond Collins said today he saw nothing in the defense’s motion to justify lowering Delatwon Haynes $2 million bond, despite arguments that his accuser is an admitted drug addict.
“I don’t find anything that would change my mind,” Collins told defense attorney Joel Brodsky and prosecutor Patricia Fix, as Haynes stood by quietly. Bail was set at $2 million by Judge Daniel Shanes last week.
Brodsky had argued that Haynes’ clean record should be enough to lower his bond to something more manageable.
“There is nothing (in his past) that would say he would not obey all court orders or he would not show up for court,” Brodsky said.
Fix countered that, saying that the charges against Haynes are serious, and testimony Shanes heard last week warranted a high bond amount. Fix also said that there is precedent for a police officer being held on high bond. Last month a judge rejected a motion to lower a $1.5 million bond on for Gurnee police officer Jay Simon, who has been jailed on charges that he sexually assaulted two young girls.
Haynes, 32, of Zion, is accused of sexually assaulting a woman in January while he worked the midnight shift. He resigned from the Waukegan Police Department a few days after allegations of rape were brought against him by the then-Waukegan resident.
Last week the State’s Attorneys Office approved charges for four counts of aggravated criminal sexual assault, one count of aggravated kidnapping, two counts of aggravated sexual abuse and eight counts of misconduct.
Brodsky argued Wednesday, and has said in the past, that the allegations are unreliable, because the accuser admitted to police that she was a heroin addict.
Fix dismissed Brodsky’s claims, saying the State wasn’t going to try Haynes in the press, or reveal information about the case before discovery was due. Fix did however reveal that a used condom gathered by Haynes’ accuser at the scene contained Haynes’ DNA.
“That’s pretty strong physical evidence your honor,” Fix told Collins.

Officer Accused Of Raping A Woman

A POLICE OFFICER accused of raping a woman on four occasions was a "typical bully" who mentally and physically abused his victim, a court has heard.
Devon and Cornwall police constable Jamie Gilbert, aged 34, of Birkdale Close, Saltash, has pleaded not guilty to four charges of rape. The alleged victim cannot be named for legal reasons.
The trial, which is expected to last two weeks, started yesterday at Exeter Crown Court, when a jury was sworn in and the prosecution made its opening statement.
Gilbert, who was a serving police officer based at Callington Police Station at the time of the alleged offences, was suspended from duty in June 2007, when the allegations were first made to police.
Sarah Munroe QC, prosecuting, outlined the case against Gilbert and the details of each of the four alleged rapes.
As background, she told the jury that Gilbert was a keen bodybuilder who took anabolic steroids in order to build his muscles and at the time of the alleged rapes he weighed between 17 and 18 stone, although he was only 5ft 8in tall. Miss Munroe also told the court that Gilbert liked watching pornographic films.
The first rape happened in November 2004 when Gilbert forced himself on the victim, despite knowing she did not want any sexual contact with him, Miss Munroe told the court. She said the second rape happened in June 2005, when Gilbert again forced himself on the woman.
The third and fourth alleged rapes happened on two separate occasions, on January 14 and January 26 in 2006, the court heard.
Miss Munroe said evidence from an independent witness would show that Gilbert had shown signs of behaving like a "typical bully" who was aggressive. The jury also heard that the alleged victim had had consensual sex with Gilbert on other occasions.
The prosecution said the victim found the courage to make the allegations to police in June 2007, after seeking help from a counsellor, and that when Gilbert was first interviewed by police, he denied all the charges, saying the victim had consented to sex on each occasion.
Miss Munroe urged the jury to try the case on the evidence put before them and to avoid being swayed by "emotion on either side".
The jury was to hear evidence from the alleged victim today.
The trial continues.

Officer Jeff Pelo on trial for Rape
Four times between the winters of 2002 and 2005, a blue-eyed man wearing a ski mask and dark clothes crept quietly into the bedrooms of women in Bloomington, Ill., and raped them.
He told the women — all in their 20s and single — that he'd studied them, tracking their habits. He threatened one woman's family if she resisted, reciting their address lest she doubt he knew where to find them.
"I've been watching you," prosecutors say the rapist told another victim as he held a knife to her throat on a December night in 2002.
On Monday, jury selection is expected to begin in the trial of the man prosecutors say was the attacker: Jeff Pelo, a 17-year veteran of the Bloomington Police Department and married father of three.
Pelo, 43, who has pleaded not guilty, faces 28 counts of aggravated criminal sexual assault and four counts of home invasion. If convicted of all the charges, he could spend the rest of his life in prison.
His lawyers have argued that police have held the wrong man behind bars the past 22 months.
They say the charges are based on shaky identifications from women who saw only a man in a ski mask in their darkened bedrooms and who were asked more than a year later to identify him.
Prosecutor Mark Messman and defense attorney Mike Rosenblat of Chicago declined to discuss evidence or other details of the case as they prepared for trial, saying they didn't want to further complicate the process of seating a jury.
The rapes were scattered over 26 months, the first occurring in December 2002, the next in April 2003 and the last two in January 2005. There was little initial indication that they might be connected, only speculation.
"There was talk, but it seems like anytime there was talk, something else would happen, would shift the focus away from it," Messman recalled.
But in December 2005, after an FBI report found strong similarities between the crimes, Bloomington police asked the public for help catching the man they came to believe was a serial rapist.
In June 2006, Pelo, a well-paid sergeant at the time, was arrested and charged with attempted burglary, after another woman called police to report a late-night prowler.
Police say that when an officer found Pelo on foot outside the house just after midnight, he tried to walk away until the officer drew his gun.
"He had a blank stare on his face," Officer David Ziemer testified during one court hearing. "I was yelling 'Stop!' and he wasn't complying with me. I thought it was going to be a deadly force situation."
Pelo finally did stop, and told the officer he was in the neighborhood looking for a house to buy his mother-in-law. The house where he was arrested wasn't for sale.

After he was charged, his wife, Rickielee, told reporters: "I know without any doubt in my heart that my husband is completely innocent of all these charges."
Messman said there are inherent problems in convincing a jury that a longtime police officer is capable of the sort of vicious, calculated crimes Pelo is charged with committing.
That said, "There are things about him being a police officer that make it more likely that he did," Messman said.
Messman declined to elaborate, but court records indicate that investigators believe Pelo used personal information from police reports and databases to stalk the women.
Other evidence includes a bag containing a ski mask, rope and a pry bar that investigators found in the home where the Pelos lived when he was arrested. Police have said the gear appears to have been used in at least one of the attacks.
Another police search turned up pornographic images of bondage and rape on Pelo's home computer.
The FBI and State Police have tested a human hair found on a pillow case in the bedroom of one of the women, a hair attached to a piece of duct tape used to bind one woman, and cat hair found on the ski mask taken from Pelo's garage.
He told the women — all in their 20s and single — that he'd studied them, tracking their habits. He threatened one woman's family if she resisted, reciting their address lest she doubt he knew where to find them.
"I've been watching you," prosecutors say the rapist told another victim as he held a knife to her throat on a December night in 2002.
On Monday, jury selection is expected to begin in the trial of the man prosecutors say was the attacker: Jeff Pelo, a 17-year veteran of the Bloomington Police Department and married father of three.
Pelo, 43, who has pleaded not guilty, faces 28 counts of aggravated criminal sexual assault and four counts of home invasion. If convicted of all the charges, he could spend the rest of his life in prison.
His lawyers have argued that police have held the wrong man behind bars the past 22 months.
They say the charges are based on shaky identifications from women who saw only a man in a ski mask in their darkened bedrooms and who were asked more than a year later to identify him.
Prosecutor Mark Messman and defense attorney Mike Rosenblat of Chicago declined to discuss evidence or other details of the case as they prepared for trial, saying they didn't want to further complicate the process of seating a jury.
The rapes were scattered over 26 months, the first occurring in December 2002, the next in April 2003 and the last two in January 2005. There was little initial indication that they might be connected, only speculation.
"There was talk, but it seems like anytime there was talk, something else would happen, would shift the focus away from it," Messman recalled.
But in December 2005, after an FBI report found strong similarities between the crimes, Bloomington police asked the public for help catching the man they came to believe was a serial rapist.
In June 2006, Pelo, a well-paid sergeant at the time, was arrested and charged with attempted burglary, after another woman called police to report a late-night prowler.
Police say that when an officer found Pelo on foot outside the house just after midnight, he tried to walk away until the officer drew his gun.
"He had a blank stare on his face," Officer David Ziemer testified during one court hearing. "I was yelling 'Stop!' and he wasn't complying with me. I thought it was going to be a deadly force situation."

Trooper Richard Keener Arrested for Rape & Sexual Assault of Minor
HARRISBURG A Pennsylvania State Trooper, who was stationed at the State Police Lamar Barracks in Clinton County, has been charged with rape and sexual assault.
Attorney General Tom Corbett identified the defendant as Richard S. Keener, 39, of Marble Lane, Bellefonte, Centre County. Corbett said that the Attorney General's investigation was launched based on a conflict of interest referral by the Clinton County District Attorney's Office.
According to the criminal complaint, Keener met the victim and her friend at a Lock Haven tavern on May 16, 2006. Keener allegedly consumed a significant amount of alcohol and asked the victim about seeing "naked girls," which she responded "no, I'm not doing that.
"The charges state that around 1:30 a.m. on May 17, 2006, Keener accompanied the victim and her friend back to her apartment after leaving the tavern. Keener allegedly followed the victim into her bedroom, shut the door, forcibly grabbed her by the neck and threw her onto the bed.
According to the criminal complaint, the victim attempted to kick Keener to make him stop, but was unable to overpower him. Keener allegedly squeezed her throat each time she tried to scream and forcibly removed her jeans and underwear while holding her down on the bed.
Corbett said that Keener allegedly bit the victim multiple times on her neck, breast, lower abdomen, inner thigh and on both shoulders.According to the criminal complaint, the victim kicked her legs and shook her head back and forth negatively, but Keener continued to bite her and allegedly proceeded to expose himself without removing his pants and forcibly had vaginal intercourse with her.
Corbett explained that Keener was about eight inches taller and 130 pounds heavier than the victim, making it difficult to counter his attack.Corbett said that Keener left to use the bathroom and the victim ran into the living room and immediately told her friend what had just happened.
Keener allegedly returned and stayed in the living room for a brief time before leaving the apartment around 3:00 a.m.The charges state that the victim became distraught and panicked after Keener left and was taken to a local hospital to be treated.
Photographs taken during a sexual assault examination showed evident bite marks on her body.Keener is charged with two counts of indecent assault and one count each of rape and sexual assault. He was preliminarily arraigned before Centre County Magisterial District Judge Thomas Jordan and released on $25,000 unsecured bail. A preliminary hearing will be scheduled at a later date. Corbett thanked the Lock Haven City Police Department for their assistance with the case.
