A Palm Beach County Sheriff’s deputy was arrested last week after allegedly battering a 5-year-old boy, leaving the child with hemorrhaging around the eyes and a swollen lip, according to a police report.
Roger Aaron Kirby, 37, was arrested Thursday and booked into the Palm Beach County Jail. Court records show Kirby was released Friday after posting $25,000 bond. Kirby is on paid administrative leave from PBSO pending an investigation.
The child, whose relationship to Kirby could not be verified, was admitted into the pediatric intensive care unit at Palms West Hospital on April 22 for what doctors diagnosed as petechial hemorrhaging that resulted from “manual asphyxiation,” the report said.
According to a medical report, the “most likely possibilities” for the boy’s injuries were that “he was smothered over the mouth and nose while he struggled to breathe or that he had ‘fallen’ off the bed and his face was forcibly pressed against the floor impeding his ability to breathe freely.”
After spending several days in the hospital, the boy was discharged. He was interviewed by a member of PBSO’s Child Protection Team but “was timid and reluctant to speak,” about what happened.
On May 22, a member of the Child Protection Team met with the boy, who said he was in the hospital because Kirby had choked him and hurt his eyes. The boy said he was in his bedroom when Kirby went into his room, whispered something then covered his mouth and nose. The report said the boy demonstrated a “choke hold” while re-enacting what happened to him. When he tried to get away, the boy said, Kirby squeezed him harder.
The boy indicated to the detective the alleged abuse has been ongoing. He said Kirby had become angry and disciplined him harshly after the boy wet the bed. The boy said Kirby has made him stand in the bathroom for “hours” and also made him jump up and down in front of the toilet. He’s forced to spend so much time in the bathroom that he falls asleep, which angers Kirby and causes him to hit the boy, the report said.
On one occasion, the child said, Kirby shoved a wet diaper into his face after a wetting accident. Kirby also “punches” him, including in the face, the boy said. Kirby is listed on his arrest report as 6-foot-4 and 250 pounds.
An unidentified person in the home cries and begs Kirby not to hurt the boy, the report said.
Kirby, a Wellington resident, joined the sheriff’s office in 2004 and works in the training division, a sheriff’s spokeswoman said.
In February 2012, Kirby was arrested after he allegedly slammed his girlfriend against an aluminum bi-fold door during an argument. Kirby told deputies that he and his girlfriend had argued about his 2-year-old daughter. The girlfriend, whose name was not released, said they had argued over Kirby’s drug use, according to the arrest report.
Court records show that the state attorney’s office did not file a charge of battery against Kirby.
Kirby is the second sheriff’s deputy arrested in less than a week.
Joaquin Fonseca, an undercover agent, was arrested and booked into the Palm Beach County Jail on May 20. He faces charges of official misconduct, possession of cocaine and false statements to a law enforcement officer during an investigation.

Former Officer Walter Urena Incest Conviction Upheld
The Louisiana 3rd Circuit Court of Appeal has affirmed the incest convictions of a retired Alexandria police officer, but it ordered a review of part of his sentencing.
Walter Urena, 66, was found guilty on five of six counts of aggravated incest in a jury trial in 2013. He was sentenced to two consecutive 20-year terms and three concurrent 10-year prison terms.
Urena, who was arrested in July 2011, appealed the convictions and the sentences on the grounds of insufficient evidence and that the two 20-year sentences were excessive.
On May 7, the appellate court sent the case back to the trial court to reconsider the consecutive 20-year sentences.
According to the appellate court’s opinion, written by Judge Billy Howard Ezell, Urena “is not one of the worst of offenders when it comes to child sexual abuse.”
The opinion also states that “while the victim in the current case was a minor, five or six when the abuse began, it did not escalate from touching and ended when the victim told him to stop. Without sufficient justification, we find that the two consecutive sentences totaling forty years is nothing more than cruel and unusual punishment.”
Rapides Parish Assistant District Attorney Monique Metoyer prosecuted the case.
She said prosecuting a public figure, such as a former police officer, carries with it a different level of expectations.
“There’s a level of disappointment you don’t have otherwise,” she said. “It’s almost incomprehensible. You think you know someone, and you don’t. It’s a total violation, and it’s a selfish, selfish act.”

Former Trooper David Morikiawa Takes Plea Deal in Child Sexual Abuse Case
A former Michigan State Police trooper will not have a retrial next week after taking a plea deal in a child sexual abuse case.
David Morikawa, 40, was convicted of second-degree criminal sexual conduct in 2011. The charges involved a victim under the age of 13. At the time the charges were filed, Morikawa was a trooper at the Iron River Post, which has since closed.
He was sentenced to two concurrent terms of 20 months to 15 years in prison, and he completed his sentence last year. After he was released on parole, the Michigan Court of Appeals granted him a new trial. Morikawa claimed he received ineffective assistance from counsel at his original trial. The retrial was scheduled to begin this coming Tuesday, the 22nd.
He has instead pleaded guilty to attempted second-degree child abuse. Morikawa will be sentenced on May 27th in the Iron County Trial Court. Under the terms of his plea agreement, he will receive credit for the time he’s already served. Morikawa also will not have to register as a sex offender and he won’t be subject to any further prison time, probation or fines.

Former Jail Guard James Kriegner Faces More Child Porn Charges
Last month a 43-year-old former New Jersey jail guard was arrested on charges of possessing child pornography. Now he is charged with creating porn with a 15-year-old girl.
James Kriegner of Bensalem, a former Mercer County corrections officer, was arrested last month after police allegedly found more than 100 images of child porn on his computer following a three-month investigation into child pornography distribution.
Bensalem Detective Kevin Cornish reportedly found that Kriegner downloaded files of known child sex abuse from an IP address registered to Kriegner's Knights Road apartment, according to a probable cause affidavit.
Kriegner, who has been unemployed since December, later turned over two laptop computers for forensic examination under a search warrant, and one had more than 100 images of child sex abuse, court documents allege. Fifteen files were identified by the National Center for Missing and Exploited Children as containing known victims of child sex abuse, police said.
The forensic examination also found image files of Kriegner video chatting with an unidentified girl, and a folder containing sexual images that appeared to be of the same girl, police said.
Kreigner identified the girl as a 15-year-old, the affidavit shows.
Police said the girl told them she had been engaging in sexual activity with Kreigner since April.
Bensalem Detective Kevin Cornish, who handled the investigation, said he is not aware of Kreigner posting or sending photographs of the girl, but that the photos have to be sent to the National Center For Missing and Exploited Children to be checked.
Kriegner was arraigned Thursday before Bensalem District Judge Leonard Brown on charges of statutory sexual assault, indecent sexual assault on a person under age 16, unlawful contact with a minor, and related child porn and sex crime offenses.
His bail was set at 10 percent of $750,000, but he remains in Bucks County prison in lieu of 10 percent of $500,000 bail from his earlier child porn arrest.

Former Ohio Officer Charged with Sex Crimes Against Minor
A former Ohio police officer has been charged with multiple sex crimes against a minor.
Media outlets report Friday's charges of rape, unlawful sexual conduct with a minor and eight other counts stem from his relationship with a woman who was a minor when he allegedly began sexually abusing her.
The reports say the 43-year-old Heath man used to be an officer in Hebron and Union Township in central Ohio.
He is accused of having a decade-long sexual relationship with a girl, now 26, when she was 8 and he was an officer.
Officials handling a child support case became suspicious when they learned the oldest of the couple's three children was 10.
The Associated Press is not naming the man to avoid identifying a suspected victim of sexual assault.

Former Officer Wilbert Jamison Fined in Child Abuse Case
Judge Cole sentenced Wilbert Jamison -- a former Gaffney police officer -- to 90 days in jail or a $500 fine plus one year of probation including 50 hours of community service.
He faced up to 10 years in prison.
Jamison has opted to pay the fine and walked out of court practically a free man.
The victim's mother -- Jamison's ex-wife -- said she is just glad the ordeal is over and glad her son did not have to testify during a trial.
In an exclusive on-camera interview with News Channel 7 after the plea hearing, Jamison said he never hit the boy with a belt as the victim alleged in Jan. 2009.
"I did make him run laps in the backyard as punishment because he had gotten in trouble at school for stealing," said Jamison. "But no abuse took place. I never hand-cuffed him and whipped him with a belt. I feel like this is just going to hurt children who really are victims of abuse."
Jamison says he agreed to plead guilty to the assault and battery high and aggravated charge because "you never know what a jury is going to do."

Officer Jack Tiller Accused of Abusing Daughter
Charges have been filed against the Walkerton police officer accused of abusing his teenage daughter.
36-year-old Walkerton Officer Jack Tiller is being charged with misdemeanor battery on accusations of abusing his 16-year-old daughter.
Tiller must appear in court on January 12th.
You may remember Tiller from his time as a Roseland police officer, when he was accused of hitting David Snyder during a town meeting.
Fast forward to the present: Tiller's daughter apparently reported the abuse to a resource officer at Penn High School. According to the police report, she had several bruises on her body.
Tiller was apparently upset because his daughter was late when he picked her up from an after-school activity.
Tiller has not been arrested. The St. Joseph County Prosecutor's Office has not decided if charges will be filed.

Officer Jack Tiller Accused of Child Abuse
A Walkerton police officer has been accused of child abuse, in an incident that was reported last week to St. Joseph County police.
Jack Tiller, an officer with the Walkerton Police Department in far southwest St. Joseph County, is accused of abusing his daughter at the family's home, allegedly punching her in the arm and face, throwing her to the ground and spitting on her after the girl and Tiller's wife got into an argument Dec. 8.
Sgt. Bill Redman, St. Joseph County police spokesman, said the girl complained to an officer at Penn High School, who reported seeing bruises on the girl's arm and head.
According to Redman, the girl told police the fight occurred after she kept her father waiting to pick her up at the school.
St. Joseph County Prosecutor Michael Dvorak said the case has been received by the prosecutor's office Special Victims/Family Violence unit, but no charging decision has been made yet.
Tiller's current status with the Walkerton Police Department is not known, as Police Chief Gary Layer was out of the office today and other officers could not comment on the case.
Town Council member Glenn Jerrell said the suspension of a police officer would be discussed before the council.
"I'm making no comment about it," Jerrell said, when asked if Tiller had been suspended.
Tiller is the former town marshal of Roseland, but left in October 2007 because the city's budget problems resulted in payroll not being met.
In December 2007, Tiller was the subject of a grand jury investigation after he was accused of battering then-Roseland Town Council member David Snyder during an arrest, but no charges were ever filed in the case.

Father Claims Police Abused his Two Boys
A father and two boys are accusing Milwaukee police officers of child abuse. They claim the offices roughed them up and used racial slurs.
The incident happened Friday when police pulled over the father and two boys at 794 and Oklahoma because the officers believed one of the boys an AK-47.
It turned out to be a toy gun but officers had no way of knowing that when they tried to arrest everyone.
There are photos of the man's 12-year-old son with red marks on his back. The father believes they are footprints from one of the officers as he tried to hold the boy down.
"I could hear my son saying, 'Stop you are hurting me,'' the boy’s father explained.
The boy’s parents don’t want their names used. They fear retaliation for filing a child abuse claim against the officers.
"These officers need to lose their jobs," said the boy’s mother. "As far as I’m concerned they are child abuser with a badge."
Police say their photos don’t support the abuse claim. But they are investigating the racial slur allegations.
"'What the M----F---- are you doing here?'" said the boy’s father as he recalled the words of the arresting officer! "'Go back to your country.'"
Reporter Charles Benson asked the dad, "There were racial slurs?"
"Yes. He called me an Asian spic," the father said.
Police said a realist looking toy gun triggered the arrest. They saw the boy’s 11-year-old friend was carrying the gun when the father picked him up. A few minutes later, the family's car was surrounded by police and the officers were yelling.
The boys said the gun had an orange tip on it, which is important because it means it’s a toy gun or fake. But when the officers recovered the gun the boys’ claim the officers removed the tip.
The boy’s father claims police never apologized and never offered to help his son who the dad said was injured and traumatized.
The father and the other boy with the toy gun were not hurt.
Police say they responded to the family allegations quickly and have started an investigation.

Officer Philip Spaman Arrested for Forcible Touching Child

An Ilion police officer Monday became the fifth law enforcement officer this year to face criminal charges in the Mohawk Valley.
Ilion Officer Philip Spaman, 47, of Herkimer, was arraigned in Herkimer County Court on Monday on misdemeanor charges involving the touching of a child.
He faces one count each of forcible touching and endangering the welfare of a child, prosecutors said.
Assistant District Attorney Jeff Carpenter said the two misdemeanor charges against Spaman were handed up in a sealed indictment from a grand jury.
The charges stem from alleged events involving a child under the age of 17 that occurred between September 2007 and October 2008, Carpenter said.
Because of the nature of the case, no information on the victim or his or her relationship to Spaman is being released, prosecutors said.
Ilion police Chief Timothy Parisi said Monday evening that Spaman had been suspended from duty with pay while internal and criminal proceedings against him move forward. Spaman has been a member of the department for almost 8 years.
“The criminal justice system must now take its course,” Parisi said in released statement that directed additional questions to the District Attorney’s Office. “I ask that you respect the judicial process and seek no further comment from the Ilion Police Department.”
Spaman was processed by the Herkimer village police department Monday morning prior to his arraignment, Herkimer police said.
He was represented at the arraignment by attorney George Aney and pleaded not guilty to both charges, Carpenter said. Aney did not return calls Monday.
A pre-trial hearing is scheduled for 9 a.m. on Wednesday, Aug. 5.
Earlier this year, two members of the state police and two other local police officers were charged with crimes. None of those cases has been resolved:
*State police Investigator Matthew Sullivan, who is suspended without pay, was indicted in April on 10 misdemeanor charges and traffic violations stemming from a Feb. 6 traffic stop in Trenton. The charges include driving while intoxicated, speeding, unlawfully fleeing a police officer, reckless endangerment, reckless driving, passing a red light, failure to keep right and failure to comply with a police officer.
*Trooper David Volz, who is assigned to the Herkimer state police barracks, was charged April 23 with misdemeanor petit larceny in connection with the alleged mulch theft in Rome. He was suspended without pay.
*Then-Dolgeville Officer Greg Malta Jr. was charged with misdemeanor fourth-degree criminal mischief, after police said he drove his patrol car around the school's baseball field. Malta was fired from the force.
*Herkimer Village Police Investigator Robert Risi, an 18-year veteran, stole $9,600 from an evidence locker, prosecutors. Risi faces a felony charge of third-degree larceny. He has been suspended without pay.

A DeKalb County police lieutenant was arrested after officials said he hit his teenage daughter with a fishing rod.
Henry County officials said they responded to a domestic disturbance call at a Stockbridge home late Monday night.
Police said Lt. Willie Durrett, who was wearing his uniform and was on duty at the time, stopped by the house to drop off a birthday present for his son.
Durrett told officials he attempted to talk to his 16-year-old daughter after she disrespected him, but she slammed a door on his arm. He pushed open the door, causing her to fall back. Durrett said when his daughter grabbed a fishing rod, he took it from her and hit her with it.
The teen had lacerations on both arms and her lower back, according to officers on the scene.
Durrett was charged with battery, cruelty to children 1st degree and cruelty to children 2nd degree.

Officer Joe Holman Arrested for Sexual Explotion of Stepdaughter

Aspen police officer Joe Holman, 38, resigned his position and turned himself in to authorities Wednesday to face allegations that he attempted to sexually exploit his teenage stepdaughter.
Holman, a six-year veteran of the police department and a city of Aspen employee since 1994, is charged with two counts of attempted sexual exploitation of a child, a class 4 felony; tampering with evidence, a class 6 felony; child abuse, a class 2 misdemeanor; and attempted criminal invasion of privacy, a class 3 misdemeanor.
He allegedly placed a camera the size of a Ping-Pong ball in his stepdaughter’s shower. The incident was investigated by the Colorado Bureau of Investigation (CBI), which elected to pursue charges. The bureau also investigated Holman after a similar accusation involving his stepdaughter surfaced last year, according to court records.
Holman was put on paid administrative leave May 29 while the CBI conducted a criminal investigation. The Aspen Police Department probed the matter internally but officials said they are not releasing their findings.
“The internal investigation has been concluded but due to the fact it’s a personnel matter, we’re not able to comment further,” Aspen police spokeswoman Stephanie Desarro said Thursday.
Holman could not be reached for comment. He turned himself in to a Pitkin County sheriff’s deputy Wednesday and was taken to jail. He was released from the Pitkin County Jail the same day on $11,000 bond.
An affidavit signed by CBI agent Brooks Bennett reports that Holman’s stepdaughter went to take a shower in her bathroom the night of April 29 when she noticed “something out of place” in the front of a mesh bag used for Holman’s younger son’s toys. Inside the mesh bag, hanging just above the top of the bathtub, she found a tiny camera contained in a waterproof case pointed toward her, the affidavit states.
Holman initially denied having knowledge of the camera. When confronted by his family, “Joe asked, ‘Do you think I did it as a pervert move?’ ... [His family members] replied, ‘I don’t know.’ Joe stated ‘if this is such a big issue, give it to me’ and he placed the camera on the floor and stomped on the camera destroying it,” the affidavit says.
The next morning, Holman admitted to putting the camera in the shower, explaining he did it because he was upset with his stepdaughter.
“Holman maintains he placed the camera only to make [her] mad. [She] had recently been disciplined, but was not following the rules set in place during the discipline,” the CBI affidavit says. “Holman figured since [his stepdaughter] was ‘pissing him off’ he would do something that would do the same to her. In 2008, [she] had accused Holman of watching her inappropriately. Holman told me those allegations gave him the idea of placing the camera in the shower. Since [she] thought he was watching her last year, he decided to place the camera to make her think he was watching her now, therefore making her mad.”
Holman claimed he placed the camera in the shower the same day it was found. The affidavit said Holman now realizes he made a mistake.
The stepdaughter told police she doesn’t believe Holman used the photos for anything sexual; she believes he wanted to make her angry.
The affidavit says that Holman “was apparently using his work laptop computer to view the digital images recorded by the camera.”
In 2008, Holman’s stepdaughter claimed she “saw things” that made her feel like her stepfather was creeping around, watching her. He walked in on her, apparently mistaking her bedroom for the laundry room, and she once saw a mirror slide underneath her bedroom door, the affidavit said.
Holman has been married to the alleged victim’s biological mother for about eight years. He and the woman have a young child together.
His first court appearance is scheduled for July 20 at 10:30 a.m. An attorney has not entered an appearance on his behalf but the affidavit identified Richard Daly, who could not be reached, as his lawyer.

Former Officer Michael Robinson Charged with Brandishing Gun at Motorist
A former Inglewood police officer was charged Wednesday with child abuse and brandishing a gun at another motorist during a freeway confrontation last year, prosecutors said.
Officer Michael Lewis Robinson, 44, surrendered to the California Highway Patrol on Wednesday and was later released on $100,000 bail.
According to the prosecutor on the case, Robinson was off-duty and driving on the 405 Freeway with his children -- ages 6 and 11 -- when he allegedly flashed a firearm in a threatening manner at another driver. Prosecutors said the confrontation occurred March 31, 2008.
In addition to one count of brandishing a weapon and two counts of child abuse, Robinson was charged with one misdemeanor count of obstructing CHP officers. If convicted, Robinson faces a maximum of nine years in prison, according to the Los Angeles County district attorney's office. He is scheduled to be arraigned May 15.
Police spokesman Lt. Mike McBride said Robinson has not been an employee of the department for about a month, but declined to give details, saying that he could not discuss personnel matters.
John Baca, president of the Inglewood police officers' union, declined to discuss the case.
The 200-strong police force has been besieged in recent years by allegations that its officers used excessive force and shot at unarmed suspects. A Times investigation last December found that officers repeatedly resorted to physical or deadly force against suspects who were unarmed or accused of minor offenses. During a four-month period in 2008, Inglewood officers fatally shot four suspects -- three of whom were unarmed.
The U.S. Department of Justice last month announced that it was launching a civil rights inquiry into the department.

Retired Deputy Terrence Greenwald Charged with Sexually Abusing Two Children

A retired Waukesha County sheriff's deputy was charged Friday with sexual crimes involving two children that occurred between July 1, 1997, and September 1, 2008, according to a criminal complaint.
Terrence L. Greenwald, 55, of Summit was charged with seven counts of first-degree sexual assault, three counts of second-degree sexual assault, eight counts of child enticement and one count of causing a child age 13 to 18 to view sexual activity. All the charges are felonies.
He was arrested on a warrant Friday, sheriff's Capt. Karen Ruff said.
Greenwald retired from the Sheriff's Department on Dec. 7, 2007, said Sue Zastrow of the Waukesha County Human Resources Division. He was hired as a correctional officer Oct. 10, 1992, and promoted to deputy Aug. 27, 1994.
According to the complaint filed in Waukesha County Circuit Court, the incidents involved Greenwald committing sexual acts individually with a boy and a girl. The girl told authorities that the first incident involving her that she could recall occurred when she was a first-grader in 1998. The last incident occurred in fall 2008, the complaint says. All of the sexual assault charges involve indecent touching, according to the complaint.
The boy told authorities that Greenwald exposed himself to the child in July 1997, when the boy was about 8, and that Greenwald caused the boy to view sexual activity in May 2004, the complaint says.
District Attorney Brad Schimel said Friday that he has appointed a special prosecutor from the Racine County district attorney's office to handle the case because the charges involve a former Waukesha County sheriff's deputy.

Corporal Rex Jones Charged with Child Abuse

DeSoto Police arrested Dallas Police Sr. Corporal Rex Jones on a charge of child abuse.
DeSoto Police say Rex Nathaniel Jones, 41, beat his 13-year-old son with an extension cord, a belt and his fists.
Jones is a Senior Corporal in the Dallas Police Department. He lives in DeSoto, and police there arrested him this morning.
According to the arrest warrant affidavit for Jones, the incident happened in late February. It says the child was asleep in his bed at about 2:00 a.m. when Jones started hitting him with an extension cord. "The victim advised he was asleep on the couch late at night with the TV on, which angered his father," explained Lieutenant Mike Sullivan with the DeSoto Police Department.
The child told police Jones told him to go to the garage and stand still while Jones hit him across the buttocks with a belt.
The boy said he moved while getting hit. When he did, Jones allegedly grabbed him, pinned him to the floor, and started punching him with his fists. "While being pinned down, listed victim stated that the Defendant hit him about the chest, back, and head with the defendant's knuckles," said Sullivan.
The teenager said he broke free from his father and started to run. When he did, the affidavit says Jones struck his son in the face with the belt.
Jones then told his son that he would receive a beating every day for the rest of the week, according to the affidavit.
It goes on to say that when he got home from school at about 3:00 p.m. that same day, Jones met him in the living room, struck him several times with a belt and sent him to his room.
The boy reported the incident to a school counselor the next day; school officials alerted authorities.
The affidavit indicates that Jones has been called to his son's school several times in the past to deal with disciplinary issues involving the boy, and that Jones beat his son in response to some of those incidents.
The DeSoto Police Officer who wrote the affidavit said he photographed several bruises and marks on the son's body, including some that appear to have been made by a belt or extension cord.
Jones is in the DeSoto jail, charged with injury to a child - a third degree felony. A Dallas Police Department spokesman says Jones is assigned to the department's training academy. He has been placed on administrative leave pending the outcome of an internal affairs investigation.
