A former police officer and mentor gets probation—not prison—after pleading guilty to child sex crimes.
Last year, Augusta cop Jerry Ballinger was arrested and charged with having sex with a 14-year-old girl. He entered a plea agreement and will serve his punishment outside the walls of prison.
Some are calling and a slap on the wrist.
Ballinger pleaded guilty in February to one count of aggravated indecent liberties with a child. And just this week, KAKE’s I-Team was the only TV crew in Butler County when Ballinger was sentenced to five years probation.
When the I-Team heard that sentence, we dug deeper to find out what the average sentence is for first time sex offenders.
In Kansas, it's is up to eight years behind bars and the convict will be placed on the state’s sex offender registry for the rest of their life.
Here’s what Judge David Ricke told the 44-year-old former cop in court:
“Ballinger falls into a category of offender who present a problem and concern for society,” he said, “and therefore must be watched closely the rest of his life and supervised.”
Ballinger worked in law enforcement for more that 20 years. He met his 14-year-old victim at the Augusta public safety office when she was volunteering as a junior firefighter.
The girl, a middle school student at the time, testified during a preliminary hearing that the cop befriended her. She said he took her out to the country several times and the two had sexual intercourse last year.
The victim’s father said he is furious with the probation sentence. He said what happened to his little girl will scar her for the rest of her life.
Assistant Butler County Attorney Cheryl Pierce prosecuted the case. She said that based on the fact that he’s 44-years-old and was a cop at the time, and the victim was a 14-year-old girl, Ballinger should be in prison based on that fact alone.
Butler County Attorney Darrin Divinney told the KAKE I-Team he entered the plea deal with Ballinger, saying, “Some cases have overwhelming evidence. This one had only circumstantial evidence. Given that fact, there was a far greater risk of acquittal.”
Divinney told the court he did not join in the defense request of just probation, but he also didn’t actively oppose the request.
Judge Ricke ruled that Ballinger would be better served for treatment on probation instead of behind bars, based on a doctor’s report.
“... The strength of doctor Steffan's evaluation report, which indicated that defendant was a low risk to reoffend, that the defendant was amenable to treatment, and that he had a favorable prognosis for treatment, and that he was favorable candidate for probation."
For many in the community, the sentence was a big disappointment.

Former Officer Alexis Robinson Arrested for Child Sex Crimes
A former police officer and head of security at a school district was arrested for multiple child sex crimes, now spanning two states.
Alexis Robinson, 51, was out on bond for sex assault charges in Kansas, when he was recently arrested by El Paso County deputies.
Robinson served as a police officer in Wichita, Kan. for 22 years. He retired as a sergeant in 2006. Then he signed on as a security supervisor with a school district in that community.
More than a year ago, police in Kansas started investigating Robinson for sexually assaulting several children after a 24-year-old man came forward saying he had been molested a decade earlier.
According to arrest papers, during that investigation detectives say an accuser in Colorado came forward, years after the alleged sex abuse. The papers say Robinson visited a family several times at their home in El Paso County in the 1990s. During those visits, the papers allege the suspect made the young boy watch pornographic movies and had him perform sexual acts.
Three victims came forward in Wichita and one has come forward in El Paso County. We are told they were all between the ages of 12 and 15 at the time of those alleged crimes.
Robinson is scheduled to be in court again later this week to discuss his bond.

Former Officer Alex Robinson Charged with Sexual Assault on Child
A former Wichita police officer and USD 259 security official is facing additional charges of child sex crimes, this time in Colorado.
This morning, 51-year-old Alex Robinson made his first court appearance in Colorado Springs. He was charged with two counts of sexual assault of a child in a position of trust.
The alleged crimes happened between June 1 and August 31 of 1996, while Robinson was visiting the state. The alleged victim was between 15 and 18 years old.
A preliminary hearing was scheduled for April 25.
Last week, Robinson made his first court appearance in Sedgwick County District Court facing similar charges:
Robinson was charged with two counts of aggravated criminal sodomy and three counts of aggravated indecent liberties in connection to crimes alleged to have occurred between 2000 and 2002. The victim in that case was 12 to 13 years old at the time.
He was also charged with aggravated indecent liberties with an 11-year-old that allegedly happened in June 2012.
Robinson is also facing two counts of indecent liberties with a 14-year-old, alleged to have occurred between August 2011 and September 2012.
He's scheduled to be back in court for a preliminary hearing in Sedgwick County on March 27.

Chief Mike Akins Arrested for Child Sex Crimes
A top central Kansas law enforcement officer is accused of rape and child molesting after being arrested Tuesday night at his Inman home.
Inman Police Chief Mike Akins is charged with 17 felonies, including rape, indecent liberties and battery, involving four children 14 years old and younger, and two misdemeanor battery counts.
McPherson County deputies and Kansas Highway Patrol members forcibly entered Akins' home to arrest him after he failed to answer the door.
The 38-year-old joined the Inman Police Department in 2005 and became chief in January 2007.
The Kansas attorney general's office and Kansas Bureau of Investigation are handling the case after being asked a week ago to investigate the chief.
Akins was being held in McPherson County Jail on $250,000 bond.

Former Officer Kyle Zumbrunn Going to Prison
A former Weston, Mo., police officer will go to prison for selling drugs in Atchison.
With his attorney, J. David Farris, beside him, Kyle Zumbrunn appeared in court Monday for sentencing before District Judge Martin Asher. Mr. Farris had two rows of witnesses sitting in the courtroom ready to testify on behalf of his client.
On Sept. 22, Mr. Zumbrunn sold 80 pills containing a controlled substance to a Kansas Bureau of Investigation undercover agent at the Wal-Mart parking lot in Atchison. Mr. Zumbrunn pleaded guilty.
Sgt. Kerry Stone, a detective with the Atchison Police Department, testified that Mr. Zumbrunn, 26, is serving his punishment every day and said he believed that probation was appropriate.
Mr. Farris told the judge that others would testify to the same thing.
The KBI agent involved in the case told Gerald Kuckelman, Atchison County attorney, that the drug deal was a fluke and Mr. Zumbrunn didn’t even know the drugs’ street value.
Mr. Kuckelman said Mr. Zumbrunn was no risk to the community and agreed with the defense’s probation recommendation.
The defendant spoke briefly before sentencing, saying he didn’t really know why he tried to sell the pills but took responsibility for his actions.
Mr. Asher had other thoughts. The judge told the packed courtroom that this was the most difficult sentencing decision he’d had to make. The defendant lost his job, his career and put shame on himself, Mr. Asher said.
“And your actions show a complete disregard for community safety,” he said.
The crime wasn’t an impulse, but something you thought about, Mr. Asher said.
“The court struggles with the fact that you were a law enforcement officer and can’t overlook that,” he said. “The appearance of justice has to apply equally ... It can’t be a two-tiered system.”
Mr. Zumbrunn will serve 15 months in state prison on the charge of distribution of a controlled substance and eight months concurrently on a second charge of illegal use of a telephone.
The pronouncement of sentence ended quiet in the courtroom as women started weeping. Atchison County Sheriff John Calhoon took custody of Mr. Zumbrunn and removed him.
Mr. Zumbrunn’s arrest led to Greg Hoffman, Weston’s mayor, asking the Platte County Sheriff’s Department to investigate police procedures for handling evidence. Three detectives are handling that investigation and the Weston Police Department’s evidence locker was seized. No date has been announced for completion of the investigation.

Former Officer Calvin Schaffer Pleads Guilty to Sending Nude Photos
A former southern Kansas police officer accused of sending nude pictures of himself to a woman he arrested pleaded guilty Wednesday to federal wire fraud for defrauding the city of his honest services.
Calvin Schaffer, formerly with the Goddard Police Department, faces up to 20 years in prison and a fine of up to $250,000 when he is sentenced Nov. 16, though he is likely to get far less under federal sentencing guidelines. The government has recommended a sentence at the low end of the guidelines, with additional reductions for his acceptance of responsibility.
Prosecutors say Schaffer, 44, offered to seek the dismissal of drunken driving charges against a Wichita woman he arrested on Feb. 27 in exchange for a sexual relationship.
In his plea agreement, Schaffer admitted using a police department computer while on duty to send e-mails and naked photos of himself to the woman. Under the deal, he would not be allowed to withdraw his guilty plea even if the judge rejects the prosecution’s sentencing recommendations.
Schaffer and defense attorney Roger Falk declined to speak to reporters as they left the courtroom following the brief hearing.
Schaffer worked as a Goddard police officer from Nov. 19, 2007, until March 26, the day after the FBI interviewed him about his relationship with Angelique Mason.
According to an FBI affidavit, Mason went to the FBI in March to file a complaint. She gave the FBI secret recordings that she and two private investigators had made of a telephone call and a meeting between her and the officer.
Mason told the FBI she initially “played along” with the officer’s sexual innuendo while en route to jail after her arrest in hopes of getting help with her criminal case, court records show.
According to the affidavit, Schaffer told FBI agents during an interview that Mason had e-mailed him nude photos of herself before he ever sent her photos of himself. He showed the photos of her to the agents, who then seized his BlackBerry.
After hearing the audio recording of one of his conversations with the woman recorded at the hair salon where she worked, Schaffer admitted that he hoped to have a sexual relationship with her, the affidavit said. He reportedly said he wanted to give Mason the impression that he could help her with her drunken driving case.
Although he acknowledged telling Mason he intentionally made mistakes while investigating her case, Schaffer told the FBI that his mistakes were actually unintentional. The mistakes included failing to report that she had prior arrests for drunken driving, the affidavit said.
It alleges that Schaffer had asked Goddard city prosecutors twice to dismiss the case against Mason, telling them mistakes he made during his investigation would embarrass him should the case be brought to trial.
In support of the federal wire fraud charge, U.S. Attorney Lanny Welch told the court that the e-mails and photos Schaffer sent while on duty affected interstate commerce because they traveled through servers in California and Virginia.

U.S. Attorney Lanny Welch told a federal judge Thursday during a hearing that he anticipated the case against Calvin Schaffer would be resolved with a plea agreement.
A change of plea hearing was set for Sept. 2 before U.S. District Judge Wesley Brown.
Prosecutors say Schaffer offered to seek dismissal of drunken driving charges against a Wichita woman in exchange for a sexual relationship.
The 44-year-old former officer was charged with one count of wire fraud after the woman, Angelique Mason, went to investigators with secretly recorded tapes.
Defense attorney Roger Falk and Schaffer declined comment.

Officer Trent Stanley Resigns After DUI Arrest
Trent Stanley has voluntarily resigned from the Topeka Police Department, effective June 26, 2009.
This comes after Stanley, 23, was arrested Thursday morning for a suspected DUI. He was booked in Shawnee County Jail at 6:20 AM on June 18th. He was brought in under three different charges, driving under the influence, no seat belt, and duty to keep right.
Trent Stanley was off duty when he was arrested.
He is the son of Captain Jerry Stanley at the Topeka Police Department.

According to the Topeka Capital Journal, he reportedly hit the two cars and a tree, then asked witnesses not to call the police.
Police Chief Ron Miller tells the paper he expects a report to be ready at the beginning of the week. He said an administrative investigation would begin after the criminal system renders its decision.

Former Officer Robert Ryan Sayler Charged with Wire Fraud
A former Lawrence police officer, once honored as a hero, is being charged with 14 federal counts of felony wire fraud, accused of selling stolen video games on eBay while employed by the police force.
Robert Ryan Sayler, 32, is suspected of devising and executing a scheme in which he purchased video games from Target, removed the video game discs from their original packaging, returned the empty boxes to Target for a complete refund and then sold the discs online, according to an indictment handed up by a Kansas City, Kan., grand jury Wednesday.
The indictment accuses the former police officer of collecting about $526 through the sale of 14 stolen Playstation 3 and Xbox video games on the online auction site eBay, between Aug. 9, 2008, and Sept. 17, 2008. The sale prices ranged from $30 to $46.
Multiple copies of the games Tiger Woods PGA Tour 09, Soul Caliber IV and Battlefield Bad Company were sold as a part of the scheme, the indictment said.
Sayler worked more than eight years for the Lawrence Police Department, from Oct. 9, 2000, until Dec. 23, 2008. He was being paid a salary of $58,333 per year when his employment was terminated, the city said.
Servers located in the states of Washington, California, Texas and Arizona are used to process eBay transactions, the indictment said. The indictment said Sayler mailed the video games to purchasers.
Capt. Tarik Khatib, who oversees the Lawrence Police Department information technology division, said the department had no comment about the indictment.
Sayler was one of five police officers who received the Lawrence Police Medal of Valor, the department’s highest award, for his rescue efforts during the deadly Boardwalk Apartment Fire in October 2005.
A court date for Sayler has not been set.

A former Goddard police officer will remain free as he continues to face a federal fraud charge.
The former officer, Calvin Schaffer, 44, entered a not-guilty plea Wednesday in his first court appearance since being charged last month.
Unless Schaffer violates terms of his release, he will remain free. His bond has been set at $10,000.
Authorities have alleged that Schaffer offered to help dismiss a DUI charge against a woman he arrested if she would have sex with him.
Authorities also alleged that while Schaffer was an officer, he used a Goddard police computer to send photos of himself -- nude and seminude -- in e-mails to the woman.
Schaffer is charged with defrauding the Goddard Police Department and the people of Goddard.

A Wichita woman secretly recorded conversations with a police officer accused of offering to get a case dismissed in exchange for sex.
According to recently unsealed court documents, Angelique Mason also sent nude pictures of herself from her cell phone to Goddard police officer Calvin Schaffer's (SHAY'-fur) cell phone. The 44-year-old Schaffer had arrested her in February for allegedly driving drunk.
He was charged Wednesday with wire fraud for allegedly sending naked pictures of himself to Mason from a computer at the Goddard Police Department while he was on duty. He no longer works for the department.
Prosecutors claim he offered to help get the case dismissed in exchange for sex.
According to court records, Mason had filed a complaint about Schaffer with the FBI.
Schaffer declined to comment Friday. Mason did not return a message seeking comment.

Hearing Will Continue for Officer Jason Judd Accused of Shooting Men
Parties will meet again April 24 in the case of Topeka police officer Jason Judd.
The date was set during a hearing this morning. Last week, a special prosecutor filed a motion asking that charges against Judd be dropped.
Last year Judd was accused of shooting two Topeka men, Daniel and Devin Llamas. The Llamas family today tells 49 News they are happy with the way today's proceedings went and say they are just looking for justice to be served.
Judd was with 3 other off-duty officers at the time.

Hutchinson Police Being Investigated for Police Brutality
Allegations of police brutality lead to an investigation of the Hutchinson Police Department.
A Hutch man says he was kicked several times by an officer during an arrest. He's hoping dash cam video of the incident leads to disciplinary action.
Tony White re-enacts his arrest by Hutchinson Police after he crashed his motorcycle last year. White admits he was drunk. His blood alcohol level was .33 and he pled guilty to DUI. That's not what he's disputing. He says the officers used unnecessary force.
"The last thing I remember is an officer saying, 'choke him out, choke him out', and then I passed out," said White.
This is what the incident looks like on police dash cam video. White is in the garage on the left.
"I'm already down and out. What am I going to do? I'm not fighting back," he said.
White admits his allegations are hard to see on tape. He says one of the officers continually kicks him. Despite being intoxicated, he says he was not resisting arrest, but there's no sound on the tape to back that up. What you can see are the injuries to his face when officers lead him out of the garage to the patrol cars. White says he had a deep cut over his eye and bruising on his side.
White wants an investigation into the incident. Hutch Police say they've done a preliminary investigation and have turned it over to the Kansas Bureau of Investigation.
In the mean time, White says he'll keep pushing until someone admits wrong doing.
"I knew I screwed up. I'm a man. I can take it," said White. "I did my time. I paid my fines. I think they need to do the same before they hurt anyone else."
White is looking for an attorney to take his case but so far hasn't been able to get one. He believes no one will represent him out of fear of taking on a police department. Other attorneys have said no because they say the video is inconclusive.

Hutchinson Police Investigate 3 Officers for Excessive Force

Hutchinson police are trying to determine if three officers used excessive force on a suspect after video surfaced of his arrest.
A police car videotape shows the arrest of Anthony White, 39, in his driveway on March 9, 2008. He was stopped for driving under the influence after he wrecked his motorcycle.
The video shows White being taken and held down by officers Bryan Rodriguez and Scott Perry, who left the department in August. Sgt. David Miller is then seen entering the garage.
"He dropped down and started kicking him," White's wife, Lisa White, said of Miller. She heard the commotion in the garage and came outside to see what was happening. "And he continued it and continued it and continued it."
Anthony White obtained the video from his attorney, who received it as evidence during the municipal court proceedings in the DUI case. White made it available to The Hutchinson News after attempts to find an attorney to represent him in a possible civil suit were unsuccessful.
The newspaper then showed it to police.
"This is the first time I've seen this," Hutchinson Police Capt. Troy Hoover said Wednesday. Hoover then began making calls to initiate an internal review of the situation.
"Although the video is initially very disturbing to watch, I don't want to make a judgment of what was going on based on what you can see in a dimly lit garage," Hoover said. "But it certainly is worthy of investigation."
Anthony White said he doesn't remember being kicked but he remembers being on the ground and hearing one of the officers tell the other to "choke him out" before briefly losing consciousness. What he next remembers, White said, is being lifted from the garage floor and seeing a puddle of blood on the cement below.
White eventually was taken out of the garage in handcuffs, bleeding from a cut above his right eye. He was arrested for DUI, obstruction and refusal to submit to a breath test, and taken to the hospital.
White pleaded guilty to the DUI charge, and the other charges were dismissed. He was sentenced to two days in jail, five days' house arrest, one year of probation and a $1,000 fine.
Lisa White said when she first saw the situation she was dumbfounded.
"I thought, 'Who did he kill?' " Lisa White said. "They don't just do that. All I know is the cops are in my garage, beating the hell out of my husband, and I had no idea why."
When she was informed that police had been responding to a report of an accident and the arrest was for DUI, she was even more confused.
"When I was told it's a possible DUI, this doesn't make sense," Lisa White said.
She said her husband was not struggling or yelling back at officers. In fact, while he was on the ground, he did not appear to be moving.
On Friday, Hoover said he expected the investigators will have turned in a report to him and Police Chief Dick Heitschmidt by Monday.
If an officer is found to have used unnecessary force with a suspect, "that is something I just won't tolerate, and I know the chief won't either," Hoover said.

Topeka Officer Charged in Off-duty Shooting
Jason M. Judd, one of four off-duty police officers who were at the scene in a southwest Topeka neighborhood when two brothers were shot early March 18, has been arrested on charges that he shot the men, District Attorney Robert Hecht confirmed at 5:28 p.m. today.
Judd is charged with two counts of aggravated battery, Shawnee County District Court records show.
Judd was accompanied by defense attorney Tom Lemon as he surrendered at Shawnee County Sheriff's Office headquarters, then was driven several blocks south to the Shawnee County Jail, where he was booked in.
Judd faces charges linked to the shootings of Daniel Llamas 27, and Devin Llamas, 18. The brothers required hospitalization for wounds suffered when they were shot during a confrontation with four off-duty Topeka police officers outside the Llamas home at 7418 S.W. 25th.
Judd will remain on paid administrative leave pending the criminal process, said Topeka police spokeswoman Kristi Pankratz. She said the officer is entitled to due process of the law, the same due process that all citizens are afforded.
Police said an internal investigation into the incident is now beginning.
The three other off-duty officers who were involved will remain on paid administrative leave at this time pending the completion of the district attorney’s review and an internal investigation. Their names haven't been released.
Pankratz said the department is unable to go into further details regarding the matter because it involves personnel.

Corrections Officer Arrested in Jail Sex Case
A corrections officer from the Saline County Sheriff's Office was arrested Monday in connection with a sex case involving three inmates at the Saline County Jail.
Sheriff Glen Kochanowski says that 27-year-old Eric Taylor was fired, and arrested, on Monday. He is accused of inappropriately touching three female inmates at the Saline County Jail on June 24th.
According to Kochanowski, Taylor was arrested following a simultaneous criminal and internal affairs investigation. Investigators believe that this was a one time event, and had not been on-going.
Taylor had been employed since June of 2006 as a corrections officer at the sheriff's office. He could face felony charges that include three counts of unlawful sexual relations by a law enforcement officer with an inmate over the age of sixteen.

Kochanowski said the three inmates were housed together. Taylor allegedly touched them in a sexual way on June 24. When the sheriff’s office received information about the allegations, an internal affairs investigation and a sheriff’s office criminal investigation were launched simultaneously.
Taylor turned himself in and bonded out immediately, Kochanowski said.

A former Overland Park Police officer and Shawnee resident was arrested June 14 on charges of shoplifting and possession of illegal substances.
Donald Kevin Duncan, 37, was apprehended for shoplifting about 3 p.m. at a Costco store, 12221 Blue Valley Parkway, Overland Park. Police then discovered that Duncan was formerly an officer in their department, from 1995 to 2005, last assigned to the investigation division.
Duncan was originally charged with theft greater than $1,000 but less than $25,000, and when he was booked, police discovered methamphetamines on his person, leading to additional charges.
Overland Park Police said Duncan resigned from the police force to pursue other interests. Duncan posted a $3,500 bond Monday after his first court appearance, and his next hearing is scheduled later this month.
